This privacy policy (the “Privacy Policy”) described how FSO Enterprises, LLC (“FSO”) and all Affiliates of FSO (FSO and all such Affiliates are collectively referred to herein as “FSO,” “us,” “our,” “we,” and similar terms as the context may suggest or require) use and protect any information that you provide or make available to FSO in any fashion, including in person or through thetease.com website or any other site operated by or affiliated with FSO (collectively, all pages, locations, and affiliated sites, the “Site”). “Affiliates” means any person, entity, or other form of enterprise that directly or indirectly controls, is controlled by, or is under common control with, a party, where “control” means the possession, directly or indirectly through one or more intermediaries, of power to direct, or to cause the direction of, the management or affairs of such entity, whether through ownership interests, contract, voting trust or otherwise. FSO is the operator and owner of the Site. FSO is dedicated to protecting the privacy of those that visit the Site.  FSO takes this responsibility seriously as a key component to earning and maintaining the trust of those that visit and utilize the Site.

Agreement Between User and FSO

FSO offers the Site to you conditioned upon your acceptance without modification of the terms, conditions, and notices contained herein. Your use of the Site or any FSO services constitutes your agreement to all such terms, conditions, and notices contained herein. FSO reserves the right to change the terms, conditions, and notices under which the Site is offered, including, but not limited to, changes associated with the use of the Site, any terms of use, or this Privacy Policy. Modification will be posted on the Site from time to time. FSO encourages you to periodically review this Privacy Policy to be kept informed about FSO’s privacy practices.

Scope

This Privacy Policy applies to FSO and any Third-Party (defined below) with whom FSO shares or collects Confidential Personal Information (defined below). “Third-Party” refers to Affiliate, agents, vendors, suppliers, subcontractors, and independent contractors, as well as any other third-party with whom FSO shares information. By submitting information to FSO or accessing the Site, you agree to FSO’s collection and use of your information as described in this Privacy Policy, as may be amended from time to time.  This Privacy Policy is made part of and incorporated into the Terms and Conditions for the Site.  If you do not agree with this Privacy Policy, you are not allowed to use the Site.  This Privacy Policy is in addition to, but is not limited by, any other terms agreed to by the parties or applicable to third-party products, services, or sites.

Collection of your Confidential Personal Information

“Confidential Personal Information” refers to information that relates to you and identifies or can be used to identify you. This information includes your name, billing address, social security number, driver’s license number, credit card number, debit card number, bank account number, email address, credit information, internet connection, the equipment you use to access the Site, usage details, and other information about you or identified by applicable law. FSO may collect Confidential Personal Information for those purposes and in the manner specified in this Privacy Policy, as well as for any other purposes as otherwise permitted by law. FSO uses Personal Information in order to give you a more enjoyable and convenient experience, and to help identify and/or provide information, products or services that may be of interest to you.

FSO may collect Confidential Personal Information through the Site (including, without limitation, through online forms or submission applications), contact with a business office, over the phone, or online. You may choose to provide this information to FSO through a number of interactions, including, but not limited by enumeration, for example (i) ordering a product or service from us or otherwise interacting with the Site, (ii) sending us an email, text or other electronic communication, (iii) registering or opting in to receive information about our products or services, (iv) applying for a job or other application, or (v) entering a contest.

FSO may also collect Confidential Personal Information about you from trusted agents who are authorized to sell FSO products or services, or from employees of our Affiliates. For training purposes, quality assurance, or other purposes, we may also monitor or record our calls with you. As part of network operations and when you visit the Site, FSO may automatically collect certain information such as your domain type, your IP address, and clickstream information to gauge the effectiveness of the Site, improve FSO’s online operations, enhance your online experience with customized content, and focus FSO’s marketing efforts to better meet the needs of FSO’s customers, or for other purposes.

FSO may store small data files known as cookies, or other similar technologies, on your computer or mobile browser when you visit the Site. Cookies allow FSO to personalize your service by collecting and storing information that will identify you when you visit the Site. Cookies also allow FSO to collect “website usage” information when you visit the Site, including, but not limited to, IP address, web browser and operating system types, web pages visited on the Site, time spent on certain web pages, and return visits to the Site. FSO may combine the website usage information with your Confidential Personal Information in order to provide a more customized online experience to you and to provide advertising about goods and services that may be of particular interest to you.  FSO may ask Third Parties to place advertisements about its products and services on sites that are not operated by FSO.  These Third Parties may use technologies such as cookies, web beacons, and similar technologies to collect, store, and read information on your computer or mobile browser when you visit one of their websites.  FSO may track user clickstream information when you view FSO’s advertising on these websites.

You may be able to disable cookies on your computer; however, if you do so, you may limit your experience on the Site, including finding pricing and availability of products and services in your area from FSO’s websites. You can set your browser to delete cookies or to tell you before you accept one. Look in your browser’s Options or Preferences menu.

FSO is not responsible for the practices, including the use of cookies, employed by websites linked to or from the Site or for the content contained therein. The websites and services you are able to access on the internet are outside the control and limits of this Privacy Policy.

Use of your Confidential Personal Information

FSO may use your Confidential Personal Information to, for example, provide you with a more enjoyable and convenient experience, provide you with and manage the products or services you request, communicate with you to maintain good customer relations or to suggest new products or services that may be of interest to you, personalize the content we deliver, conduct industry or customer surveys, manage, improve and troubleshoot our network and services, enforce any contract with you, or for any purpose otherwise permitted or required by law.

FSO may use the information collected on its Site to provide you with the information you requested. When you use the Site to order products or services, or to request information about them, FSO may use the information it has about you as it would use the same information obtained offline, for example, to evaluate your service needs and contact you regarding additional services you may find useful. You may also submit applications for employment online, and FSO may use the information you provide to consider you for employment.

There may be instances when FSO may access or disclose Confidential Personal Information without notice or your consent in order to: (i) protect or defend the legal rights or property of FSO, its Affiliates or its/their employees, agents and contractors (including enforcement of FSO’s agreements); (ii) protect the safety and security of customers or members of the public including acting in urgent circumstances; (iii) protect against fraud or for risk management purposes; or (iv) comply with the law or legal process, such as a subpoena.

FSO may share or sell information collected about you, that has been anonymized or aggregated in a manner that renders it unidentifiable with you, to Third Parties for marketing, research, and other purposes. If FSO obtains Confidential Personal Information from a Third-Party, its use of that information is also governed by this Privacy Policy. FSO may use the information it may have collected from you to enable FSO to display advertisements to FSO’s advertisers’ target audiences. Even though FSO does not disclose your personal information for these purposes without your consent, if you click on or otherwise interact with an advertisement, the advertiser may assume that you meet its target criteria.

Sharing of Your Confidential Personal Information

FSO may share Confidential Personal Information for purposes permitted by law without your consent in order to provide services for you.  Your Confidential Personal Information may be shared with Affiliates and Third Parties for the purposes of marketing products and services. Depending on the circumstance, notice (such as provided in the preceding sentence) and opt-out may be a permissible means of obtaining your consent to such sharing.

Affiliates and Third Parties are permitted to obtain only the Confidential Personal Information they need, and are prohibited from using it for any purpose other than those permitted by law or with your consent.  Except as provided in this policy, FSO does not sell your Confidential Personal Information to Third Parties for any purpose other than to enforce its rights under any agreements with you or as expressly stated in this Privacy Policy or for the purposes of marketing our products and services. For example, FSO may sell past-due accounts in an effort to collect for unpaid services. If FSO sells all or part of its business or makes a sale or transfer of all or a material part of its assets or is otherwise involved in a merger or transfer of all or a material part of its business (including any transfers made as part of an insolvency or bankruptcy proceeding), FSO may transfer your Confidential Personal Information to the party or parties involved in the transaction as part of that transaction.

Security of Your Confidential Personal Information

FSO is committed to protecting the information it receives from you.  However, FSO is not liable for disclosure, loss, unauthorized access, destruction, use, or modification of your Confidential Personal Information due to errors in transmission or unauthorized acts of Third Parties. FSO has undertaken commercially-reasonable efforts to prevent unauthorized access to visitor data retained on its servers. However, due to the inherent open nature of the internet, FSO cannot ensure or warrant the security of any information you transmit to it, or any information provided online, and you do so at your own risk.

Collection and Use of Children’s Confidential Personal Information

The Site and FSO’s services are not intended for general audiences and are not directed to persons under the age of 18 (or other age as provided by applicable law). FSO does not knowingly collect and has no intention of collecting, maintaining, processing, or soliciting Confidential Personal Information, or any information submitted by persons under such age.  If you are not 18 or older, you are not authorized to use the Site.  Parents should be aware that there are parental control tools available online that can prevent children from submitting information online without parental permission or from accessing material that is harmful to minors. If a child under age 18 has provided FSO with Confidential Personal Information, FSO will use all reasonable efforts to delete such information from its database. If you become aware that a child under age 18 has provided us with personal information without parental consent through the Site or otherwise, please contact us through the contact section of the Site or otherwise.

California Residents

This Section 11 applies to all users who reside in the State of California and is adopted to comply with the CCPA. This Section does not apply to employment-related personal information collected from California-based employees, job applicants, contractors, or similar individuals. The CCPA provides consumers (California residents) with specific rights regarding their personal information. This Section describes your CCPA rights and explains how to exercise those rights.

You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months. Once we receive and confirm your verifiable consumer request, we will disclose to you:

  • The categories of personal information we collected about you;
  • The categories of sources for the personal information we collected about you;
  • Our business or commercial purpose for collecting or selling that personal information;
  • The categories of third parties with whom we share that personal information;
  • The specific pieces of personal information we collected about you (also called a data portability request);
  • If we sold or disclosed your personal information for a business purpose, two separate lists disclosing:
  • sales, identifying the personal information categories that each category of recipient purchased; and
  • disclosures for a business purpose, identifying the personal information categories that each category of recipient obtained.

You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies. We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities;
  • Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, or otherwise perform our contract with you;
  • Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 seq.);
  • Debug products to identify and repair errors that impair existing intended functionality;
  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent;
  • Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law;
  • Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us;
  • Comply with a legal obligation; or
  • Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

To exercise the access, data portability, and deletion rights described herein, please submit a verifiable consumer request to us by either (i) calling us at the number provided above; or (ii) sending us an email at the address provided above.

Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child. To designate an authorized agent please email us at the email address provided below and provide your name and phone number as well as the authorized agents’ name and contact information (phone number or email address) and let us know what the scope of the authorized agents’ rights are to act on your behalf. If your authorized agent requests sensitive information about you then we may ask you to provide us with a sworn declaration to further verify your identity.

You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative, which may include your full name, email address, phone number and zip code.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. Making a verifiable consumer request does not require you to create an account with us. We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

We attempt to respond to a verifiable consumer request within sixty (60) days of its receipt (or shorter, if required by applicable law). If we require more time, we will inform you of the reason and extension period in writing. If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option. Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or unreasonable. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:

  • Deny you goods or services.
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
  • Provide you a different level or quality of goods or services.
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request in writing to us using the contact information provided below.

Accessing and Updating Your Confidential Personal Information and Preferences

FSO takes reasonable measures to assure that the Confidential Personal Information we use about you is accurate, complete, and up-to-date. We make good faith efforts to provide you with access to you Confidential Personal Information either to correct this data if it is inaccurate or to delete such data at your request if it is not otherwise required to be retained by law or for legitimate business purposes. If you are a registered user, the Site allows you to access and update your registration information and your preferences to receive email or other communications. FSO will take commercially-reasonable steps to implement your opt-out requests promptly, but you may still receive communications from FSO for a period of time as your request is processed. 

Enforcement of this Privacy Policy

Our employees, agents, and affiliates are required to adhere to this Privacy Policy, and FSO’s policies, which support its commitment to protecting customer privacy. Failure to comply with this Privacy Policy or FSO’s policies may result in disciplinary action up to and including termination of employment.
